SMALL BUSINESSES

The U.S. Small Business Administration is offering up to $2 million in Disaster Assistance Loans to small businesses negatively affected by coronavirus. For more info, call 1-800-659-2955 (TTY: 1-800-877-8339) or e-mail disastercustomerservice@sba.gov.

The New York State Department of Labor is waiving the 7-day wait period for those laid off due to coronavirus closures or quarantines. For more information, click here.

The Department of Finance has issued a waiver of penalties for those unable to meet certain filing and payment deadlines for DOF-administered business and excise taxes due between March 16, 2020 and April 25, 2020. Taxpayers may request to have penalties waived on a late-filed extension or return, or in a separate request.

EMPIRE STATE DEVELOPMENT EXPANDS NEW YORK FORWARD LOAN FUND TO INCLUDE PAYCHECK PROTECTION PROGRAM RECIPIENTS  

Previously Ineligible New York State Small Businesses Can Receive Low-Interest Working Capital Loans  

Available to Small Businesses That Received PPP Assistance of $50,000 or Less  

Empire State Development (ESD) today announced that Paycheck Protection Program (PPP) recipients are now eligible to receive low-interest loans from the New York Forward Loan Fund (NYFLF). This conditional change will provide the Fund’s network of lenders and financial institutions with greater flexibility and enable them to provide more small businesses with working capital to cover expenses associated with reopening.  

ESD Acting Commissioner, and President and CEO-delegate Eric Gertler said, “The coronavirus pandemic was an unprecedented challenge to the state’s business community, of which ninety-eight percent are small businesses. Providing assistance and opportunity – particularly to our state’s minority- and women-owned businesses – to help them reopen is essential toward revitalizing our economy and building New York back better.” 

When the NYFLF launched in May, the federal Small Business Administration had just issued rules regarding companies’ eligibility for federal assistance. The goal of the NYFLF was to help New York-based small businesses that did not receive PPP funding with flexible working capital to reopen and adapt to post-COVID needs. Companies with 20 employees or less make up 90% of New York’s business community, and it was critical to provide a funding lifeline to those businesses shut out of federal assistance.   

However, some NYFLF applicants who needed assistance were deemed ineligible because they had already received PPP funds. Through discussions with lenders and applicants, it became apparent that PPP loans did not go far enough to support New York-based small businesses. Legislative criteria restricted how the government assistance could be spent, and oftentimes PPP amounts were a fraction of what was needed and requested.  

Starting today, NYFLF Community Development Financial Institutions (CDFIs) will contact previously ineligible applicants to determine if they are still interested in funding and begin the underwriting process. This is limited to small businesses who received $50,000 or less in PPP assistance. The fund is prepared to process the new applications from this change while also working with existing applicants. Small business who did not receive any federal assistance are still eligible and encouraged to apply. Additionally, the program goal of providing at least 60% of loans to Minority- and Women-Owned Business Enterprises (MWBEs) remains, and that goal will not change due to the newly-expanded eligibility.  

Eligible small businesses and small residential landlords can apply for a 60-month, no-fee loan with a 3% fixed interest rate; while eligible non-profits can apply for a 60-month, no-fee loan at 2% fixed interest. The maximum loan amount is $100,000. Loan funds can be used for working capital including payroll, operating and emergency maintenance, property taxes, utilities and costs associated with refitting physical space to follow social distancing guidelines. The five CDFIs processing applications are Accion East, Community Preservation Corporation, National Development Council, Pursuit and TruFund Financial Services. Seven banks have pledged support for the New York Forward Loan Fund: Apple Bank, BNB Bank, Evans Bank, HSBC, M&T Bank, Morgan Stanley and Wells Fargo. Additionally, the fund has received philanthropic commitments from the BlackRock Charitable Fund, Citi Foundation, Ford Foundation, and the Ralph C. Wilson, Jr. Foundation. The New York Forward Loan Fund was established with support from Calvert Impact Capital. The Local Initiatives Support Corporation (LISC) is administering the fund, and Connect2Capital is hosting applications.

Initiative First Announced in Governor’s 2021 State of the State Address

 

Governor Andrew M. Cuomo today announced the launch of Excelsior Pass – a free, voluntary platform developed in partnership with IBM, which utilizes proven, secure technology to confirm an individual’s recent negative PCR or antigen test result or proof of vaccination to help fast-track the reopening of businesses and event venues in accordance with New York State Department of Health guidelines. Similar to a mobile airline boarding pass, individuals will be able to either print out their pass or store it on their smartphones using the Excelsior Pass Wallet app. Each Pass will have a secure QR code, which participating businesses and venues can scan using a companion app to verify proof of COVID-19 negative test results or proof of vaccination. An individual’s data is kept secure and confidential at all times.

 

As part of this initial launch, participating New Yorkers may choose to use Excelsior Pass to verify their COVID-19 vaccination or negative test results as needed to gain entry to major stadiums and arenas, wedding receptions, or catered and other events above the social gathering limit. Interested New Yorkers can opt in to use Excelsior Pass and learn more here; interested businesses can opt in and learn more here. Major venues have already announced they will begin utilizing this technology in the coming weeks, including Madison Square Garden in New York City beginning next week and the Times Union Center in Albany. Beginning April 2, Excelsior Pass will expand to smaller arts, entertainment and event venues. 

 

“New Yorkers have proven they can follow public health guidance to beat back COVID, and the innovative Excelsior Pass is another tool in our new toolbox to fight the virus while allowing more sectors of the economy to reopen safely and keeping personal information secure,” Governor Cuomo said. “The question of ‘public health or the economy’ has always been a false choice — the answer must be both. As more New Yorkers get vaccinated each day and as key public health metrics continue to regularly reach their lowest rates in months, the first-in-the-nation Excelsior Pass heralds the next step in our thoughtful, science-based reopening.”

 

New York State is the first state in the U.S. to formally launch this potentially transformational technology. Prior to its launch, two successful pilot demonstrations were held in recent weeks, along with a beta test where thousands of New Yorkers participated in a limited roll out of the technology to provide feedback on user interface and results.

Excelsior Pass is built on IBM’s Digital Health Pass solution and is designed to enable the secure verification of health credentials such as test results and vaccination records without the need to share underlying medical and personal information. The technology is flexible and built to scale, allowing other states to join and help foster a safer, trusted transition to a post-pandemic reality. The pass can also be printed and is complementary to other types of proof that patrons can use, reducing any barriers to usage.

 

A special emphasis has been placed on the protection of an individual’s privacy. Secure technologies, like blockchain and encryption, are woven throughout Excelsior Pass to help protect the data, making it verifiable and trusted. No private health data is stored or tracked within the apps. Excelsior Pass can be used to voluntarily show a QR code as proof of COVID-19 vaccination or negative test result via a digital smartphone wallet or printed credential without sharing underlying personal health details.

 

Multiple security systems are in place to ensure the integrity of personal health information. Excelsior Pass was designed with equity and equal access at the forefront. With multi-language access, a robust Help Desk, and multiple ways to use Excelsior Pass — whether you have a smartphone or not — New York is committed to ensuring that all New Yorkers can participate in the safe, convenient and responsible reopening of our economy.

 

The following set of labs have committed to rapid reporting of COVID test results to the State Department of Health’s Electronic Clinical Laboratory Reporting System (ECLRS), which will help ensure that Excelsior Pass users are able to receive their testing results in the required window of time before an event: Acutis Diagnostics, Aegis Sciences Corporation, BioReference Laboratories, Boston Heart Diagnostics, Broad Institute, Cayuga Medical Center, Clarity Lab Solutions, Lenco Diagnostic Laboratories, The Mount Sinai Hospital’s Center for Clinical Laboratories, Northwell Health, Rapid Reliable Testing and UR Medicine Labs. The State continues to work with other labs and rapid testing sites to expand this list of partners and expedite reporting so users have timely, accurate results to participate in congregate economic and social activities.

Governor Cuomo also recently announced the expansion of the New York Forward Rapid Test Program to help businesses, catered events, professional sports games with fans, and events, arts, and entertainment venues safely reopen, with dozens of sites now open statewide. This unique public-private partnership makes low-cost rapid testing more available to the public to support enhanced economic activity as the State continues to reopen sectors of the economy.
